Terms of Service

These terms govern your use of the DataSpark website and services, including buying data bundles as a guest or with an account, running a reseller store, and using our developer API. By placing an order or creating an account you agree to them. If you do not agree, please do not use the service.

1. What we provide

DataSpark sells mobile data bundles for MTN, Telecel and AirtelTigo in Ghana. When you buy a bundle, we send it to the mobile number you provide. Bundles are supplied over the networks' own systems, so delivery depends on those networks being available.

2. Placing an order

You can buy as a guest or from your account. Guests must give a valid email address and the mobile number to receive the data.
Check the number and network before you pay. Data is delivered to the number you enter. We cannot recall or redirect a bundle that has been delivered to a wrong or wrongly-networked number.
The recipient number must be active and eligible to receive the selected bundle on that network.

3. Prices and payment

Prices are shown in Ghana cedis (GH¢). Bundle prices can change; the price and total shown at checkout when you pay is the one that applies to your order.
A payment processing fee (currently 3%) is added to guest checkout and shown as a separate line before you pay.
Payments are handled by Paystack using Mobile Money or card. We do not see or store your card or Mobile Money PIN.

4. Delivery, delays and failed orders

Most orders are delivered within minutes, but network or supplier issues can cause delays. If you have paid and your data has not arrived, contact us with your order reference. Please do not pay again for the same order. Where an order cannot be delivered, we will either re-deliver the bundle or refund the amount paid, after reviewing the order. Orders that were delivered successfully to the number provided are not refundable.

5. Accounts and wallet

You are responsible for keeping your login details safe and for all activity under your account.
Give us accurate information when you register and keep it up to date.
Money added to your wallet is used to pay for orders on the platform. Contact support if you believe a wallet balance or transaction is wrong.

6. Reseller stores

Store owners set their own selling prices. The difference between the store price and the base price is the store owner’s earnings.
Earnings can be withdrawn to Mobile Money, subject to our checks and any minimum withdrawal set on the platform.
Store owners are responsible for how they advertise and for their dealings with their own customers. We may suspend a store or hold withdrawals where we suspect fraud, abuse or a breach of these terms.

7. Developer API

API access is provided with a private key. Keep your key secret, use it only for your own business, and do not share it. You are responsible for all orders placed with your key. We may limit, suspend or revoke a key that is misused, compromised or used to harm the service.

8. Acceptable use

You agree not to: use the service for fraud or money laundering; use someone else’s payment method without permission; attempt to break, probe or overload our systems; abuse promotions or pricing errors; or resell in a way that misleads customers about price or delivery.

9. Availability

We work to keep the service running, but we do not promise it will always be uninterrupted or error-free. We may pause or change parts of the service for maintenance, supplier changes or security reasons.

10. Our responsibility

To the extent the law allows, DataSpark is not liable for losses caused by network or supplier outages, delays outside our control, or orders sent to a number entered incorrectly by the customer. Our total liability for any single order is limited to the amount paid for that order. Nothing in these terms limits rights you have under Ghanaian consumer protection law.

11. Suspension

We may suspend or close an account or refuse an order if we reasonably believe these terms have been broken, or to protect customers or the service.

12. Changes to these terms

We may update these terms from time to time. The date at the top shows when they were last changed. Continued use of the service after an update means you accept the new terms.

13. Governing law

These terms are governed by the laws of the Republic of Ghana.
